Gym Contracts in Korea: Cancellation Rights and How Refunds Are Calculated

Why the contract is long and why that matters
Korean gyms price aggressively by term. A one-month membership costs several times the monthly equivalent of a twelve-month prepayment, so the sales conversation pushes hard toward the long term.
That is a legitimate discount, but it changes what you are buying. A twelve-month prepayment is a large lump sum handed to a business in advance, and what happens if circumstances change — you move, your visa ends, the gym closes — is decided by the cancellation terms, not by the monthly rate you compared.
Before signing, establish three things
- The cancellation formula — how a mid-term refund is calculated
- The transfer and suspension policy — can the membership be paused for travel or illness, and for how long
- What happens if the business closes — prepaid money is unsecured if the operator fails
Ask for the contract in writing and take a photograph of it. Verbal assurances at the counter are worth very little when a dispute starts months later with different staff.
Watch for the cash discount — a lower price offered for a payment made without a receipt or card. It usually means no record, and no record means a much weaker position if you later need a refund. Pay by card where possible; card payment also gives you a chargeback route in some circumstances.

The right to cancel mid-term
Korean consumer protection rules provide for cancellation of continuing service contracts. A sign reading “no refunds” does not extinguish a right the rules give you.
The general shape of a refund
Refund = amount paid
− value of the period actually used
− a cancellation charge
Two details do most of the work:
1. The used period is valued at the short-term rate, not the discounted rate
If you paid a twelve-month price and cancel after two months, the two months used are generally charged at the one-month or three-month list price — not at one sixth of what you paid. This is why refunds feel smaller than expected. It is not necessarily the gym cheating you; it reflects that you did not, in the end, buy the long term.
2. A cancellation charge applies
A percentage of the remaining value is deductible as a cancellation charge under the standard terms.
Where the operator is at fault — the gym closes, moves, cuts facilities substantially, or fails to provide what was contracted — the calculation is different and more favourable to the consumer, and the cancellation charge may not apply.
Personal training is separate
PT packages are counted by session, not by elapsed time. If you bought twenty sessions and used three, the refund is based on twenty minus three, with the three valued at the single-session rate. Time passing does not consume sessions. Gyms sometimes assert that an unused package has expired; whether an expiry term is enforceable is exactly the kind of question the consumer agencies handle.
Put the cancellation in writing. A dated message or letter creates the record that a counter conversation does not.
When the gym refuses
Refusals are common enough that there is a well-worn route.
Step 1 — Written request
Send a clear, dated cancellation request stating the contract date, amount paid, period used and the refund you calculate. Keep a copy. A message through the gym’s official channel or a text to the manager is adequate evidence; content-certified mail (naeyongjeungmyeong, 내용증명) is stronger and is the conventional escalation.
Step 2 — Consumer agencies
- Korea Consumer Agency — handles consumer complaints and operates a counselling and mediation process
- 1372 Consumer Counselling Centre — the national consumer helpline, which routes complaints and provides guidance
These services are free and deal with gym contract disputes constantly. Mediation carries real weight, because businesses that refuse it face escalation.
Step 3 — Card chargeback
If you paid by card in instalments, there may be a route to suspend payment of the remaining instalments where the service is not being provided. Conditions apply, including a minimum amount and remaining instalments. Contact the card company promptly rather than after the instalments have run.
Step 4 — Small claims
For amounts within the small-claims threshold, the simplified court procedure is available and does not require a lawyer. It is a real option for a gym contract, though slower.

Documents to keep from the start
- The contract
- Payment receipt or card statement
- Any messages with the gym
- Photographs of posted notices about refunds or opening hours
- Records of attendance if disputed
Practical points on joining
Suspension (hyugyeo, 휴회)
Most gyms allow a membership to be paused for a limited number of months, often requiring notice and sometimes documentation for medical reasons. Confirm:
- Maximum suspension period
- Whether notice must be given before the period starts — retroactive suspension is usually refused
- Whether suspension extends the end date
This is more useful than it sounds for anyone travelling home for several weeks a year.
Transfer
Some contracts permit transfer to another person for a fee. Where you may leave Korea before the term ends, a transferable membership is materially more valuable than a non-transferable one.
What is included
Base membership in Korea often excludes items that are bundled elsewhere:
- Locker rental — frequently a separate monthly charge
- Gym clothes (undongbok, 운동복) — many gyms provide and launder these for a fee, which is genuinely convenient
- Towel service
- Group classes — sometimes included, sometimes extra
- Shower and sauna — usually included
Compare the total, not the headline membership figure.
Short-term alternatives
If your stay is uncertain, consider:
- Public sports centres run by district offices, which are inexpensive and usually offer short terms
- Monthly rolling memberships at a higher rate but with no lock-in
- Class-based studios that sell small session packs
Paying more per month for a term you can actually complete is frequently the cheaper decision.
Before you sign, ask directly: “If I leave Korea in six months, what do I get back?” A clear answer is a good sign. An evasive one tells you what the dispute will look like.
